Terms and conditions of sale
Objet
The general rental conditions detailed below set out the rights and obligations of the lessor and his customers in the context of the rental of the gîte « The Shelf ». Acceptance of and compliance with these terms and conditions are deemed to have been accepted at the time of booking.
Payment
The reservation becomes effective as soon as the customer confirms payment by credit card or bank transfer.
Departure and Arrival
Arrival
Arrival is from 5pm.
The tenant receives a code by e-mail on the morning of or the day before his or her entry into the rental property, giving him or her independent access to The Shelf for the entire period booked. This code is entered on a keypad located to the right of the garage door. It unlocks the garage door and the front door of the gite.
An inventory of fixtures and fittings will be made available to the tenant on arrival. In the event of disagreement, the tenant has 2 hours to contact The Shelf by SMS or e-mail. After this time, the tenant’s acceptance of the inventory will be acquired.
Departure
Departure must be before 12 noon the following day.
End-of-stay cleaning is included in the rental price. The tenant undertakes to leave the gîte clean*, in particular to put his garbage in the rubbish bags provided for this purpose.
*However, should our staff observe any abuse in this respect, a deduction of €50 will be made from the security deposit.
In the event of damage, the cost of restoring the gite to its original condition, as well as the cost of replacing interior and exterior furniture, equipment or decorative objects, will be deducted from the security deposit. Should the amount of these expenses exceed the amount of the security deposit, the tenant undertakes to pay the difference.
If The Shelf does not receive any complaint within 24 hours of the tenant’s departure, the premises will be returned in good condition (inventory and inventory of fixtures).
Use of the premises
The tenant shall use the rental in a peaceful manner and shall make good use of it in accordance with the intended purpose of the premises.
- The Shelf may not be used for any purpose other than living;
- The tenant undertakes to behave in a manner respectful of the residents and the environment in general;
- The Shelf is reserved for adults over 18;
- The number of tenants may not exceed the accommodation capacity, i.e. 2 people. Any breach of this clause may result in immediate termination of the present contract, to the detriment of the tenant, with the amount of the rental remaining definitively with the lessor.
- Smoking is strictly prohibited inside the gîte (an ashtray is available outside);
- For reasons of hygiene, pets are not allowed;
- The sauna is to be used with care – it is forbidden to pour too much water into the heater. The user manual is available nearby in several languages.
- The internet access provided will be used in accordance with the law. The Hirer will not be held responsible for any illegal activity within The Shelf.
Cancellation or modification conditions
Cancellation or postponement requests must be sent by e-mail. Charges vary according to the date of receipt of the request (see special conditions for Booking and Airbnb)
More than 3 days before the rental start date : any sums received will be reimbursed by The Shelf. It is possible to postpone your stay to a later date.
Less than 3 days before the rental start date or in case of no-show : the entire stay will be due as compensation, unless otherwise agreed with The Shelf (e.g. in the event of re-letting to other tenants on the dates concerned). In this case, the stay may also be postponed to a later date.
If the cancellation is the lessor’s fault, in the event of force majeure or unforeseen circumstances such as breakdown, flooding, damage caused by the previous tenant, compulsory renovations, etc., the lessor must reimburse the tenant for the deposit paid and the balance of the price of the stay.
In the event of non-compliance with the conditions of use of the rented property, the rental may be terminated immediately and by operation of law by the owner, without compensation or indemnity. The Tenant undertakes to vacate the premises within one hour of notification of such termination.
Premature departure by the Tenant, for whatever reason, does not entail any reimbursement – even partial – of the price of the stay.
Under no circumstances may the tenant invoke any right to remain in the premises after expiry of the period initially booked, except by prior agreement with The Shelf.
Insurance
The tenant occupies the premises with due care and attention. He/she is responsible for the rented property, equipment and grounds made available to him/her. The lessee shall reimburse the lessor for any expenses incurred and undertakes to report any damage. By renting the accommodation, the tenant is legally bound to return it in the condition in which he received it, including in the event of fire (art 1732, 1733 and 1735 of the CC.). Where applicable (see special clauses), the tenant must take out a comprehensive FIRE insurance policy to cover his rental liability, both for rental risks (the building) and for the contents (furniture, etc.) made available to him. These risks may be covered by the « holiday » extension of the tenant’s FIRE insurance policy. Please contact your insurer to check your policy.
Recognition by the Commissariat Général au Tourisme (General Commissariat for Tourism)
The Shelf certifies that the rented property complies with the provisions of the Walloon Tourism Code of April 1, 2010.
Disputes
Should the parties fail to reach an agreement, they shall submit their grievances to the Gîtes de Wallonie secretariat, which will attempt to find an amicable solution. Failing this, the courts of the judicial district in which the property is located shall have sole jurisdiction.
